Terms of Service.
1. Parties and scope
These Terms of Service govern all purchases made through pelicanwebdesign.com from Pelican Web Design di Rossi Marco, Piazza Guido Rossa, 4, 50050 Stabbia FI, Italy, VAT IT05892340480 ("Pelican Web Design"), by any client ("Client") placing an order on this website.
2. Services offered
Pelican Web Design provides digital web design and development services including: Business Website Design, E-Commerce Design, Landing Page Design, Website Redesign, and Website Care Plans. All services are delivered digitally. Physical goods are not sold. Delivery is electronic via Figma files, hosted website, and email documentation.
3. Orders and payment
Orders are placed through the website and paid via Stripe, Inc. at the time of order. All prices are in Euro (EUR) and exclude Italian IVA (22%). Payment must be completed before project work begins. Pelican Web Design reserves the right to cancel an order and issue a full refund if it is unable to deliver the agreed service.
4. Delivery and timelines
Estimated delivery timelines are: Landing Page (2–3 weeks), Business Website (4–5 weeks), Website Redesign (4–6 weeks), E-Commerce (6–8 weeks), Care Plan (ongoing, initiated within 5 business days). Timelines begin from the completion of the initial brief meeting, not from the date of payment. Delays caused by the Client's failure to provide materials or feedback will extend the timeline proportionally.
5. Revision rounds
Each package tier includes a defined number of structured revision rounds (Starter: 1, Studio: 2, Pro: 3). A revision round consists of a single consolidated feedback document covering all deliverables at once. Open-ended ongoing feedback cycles beyond the included rounds are billed at the hourly rate.
6. Client responsibilities
The Client is responsible for supplying required content (text, brand assets, images), access credentials, and timely feedback during the project. Projects stalled for more than 30 days due to Client inaction may be subject to rescheduling or cancellation per the Refund Policy.
7. Intellectual property
On receipt of full payment, all project-specific design deliverables become the property of the Client. Pelican Web Design retains the right to display completed work in its portfolio unless the Client requests confidentiality in writing before project commencement.
8. Limitation of liability
Pelican Web Design warrants that all work will materially conform to the agreed project brief. Our total liability for any claim shall not exceed the fees paid for the relevant project. We are not liable for indirect or consequential damages including but not limited to loss of revenue, data, or business opportunity.
9. Governing law and jurisdiction
These Terms are governed by Italian law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Florence (Firenze), Italy.
